Studio Rental Agreement

This agreement is between Polished Pix Productions (hereafter “FACILITY MANAGER” or the “FACILITY MANAGER”) and “STUDIO CLIENT” or the “STUDIO CLIENT”.

Please read these Terms of Service carefully before booking a SHOOT or a PACKAGE.

By booking a SHOOT or a PACKAGE, you engage in the FACILITY MANAGER’s “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, clients, customers, merchants, and/ or contributors of content.

Any new features or tools which are added to the current site shall also be subject to the Terms of Service. The FACILITY MANAGER reserves the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to the website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes. By booking a SHOOT or our service(s), you agree to the Terms of Service and Conditions.

This Terms and Conditions is for services and products related to a photography shoot or service package to be held at the time(s) and place(s) of the confirmed booking. 

If the FACILITY MANAGER provides a quote to the STUDIO CLIENT, the fee will be charged at that agreed rate and in accordance with their specified payment arrangements. The STUDIO CLIENT may be required to complete a Booking Form. Some services will require full-payment or part-payment as a retainer fee before the session commences. All payments are final and non-refundable. On receipt of a completed booking form, retainer fee or full-payment, The FACILITY MANAGER will send an email as confirmation. The booking will then be considered Confirmed.

Once the STUDIO CLIENT has made a booking for a specific time and date and this date/time has been Confirmed by The FACILITY MANAGER, and the required payment has been paid, The Photographer will not accept any other work from other studio clients for those times and dates.

When a booking is Confirmed and is subsequently cancelled by the studio client, the studio client forfeits the retainer fee. 

​The FACILITY MANAGER will endeavour to put the Studio Client in touch with another studio in the event The FACILITY MANAGER is unable to provide a usable studio space on booked date due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding etc. In the event of such cancellation by The FACILITY MANAGER, liability shall be limited to a full refund of any fees paid to the FACILITY MANAGER by the Studio Client at that time.

It is the STUDIO CLIENT's responsibility to take care of the children; The FACILITY MANAGER will not accept any responsibility due to any accident to children or damage to public or private properties during the SHOOT or consultation session.

The STUDIO CLIENT acknowledges and accepts the risks associated with each SHOOT or service PACKAGE, which can include accidents or injuries, and agrees to be responsible for their own welfare.

The FACILITY MANAGER does not accept any liability for:

a. Injury or actions of third parties or service providers

b. Damage or loss of personal belongings

c. Any outcomes resulting from other participants taking photos or videos.

The FACILITY MANAGER is not responsible for any personal injury, accidents, or lost/damaged property belonging to the renter, crew, or guests during the booking.

By renting the studio, The STUDIO CLIENT confirms that they are in good enough health to participate, have appropriate insurance that include but are not limited to travel and medical insurance, and will follow all safety instructions from staff and contractors. 

The STUDIO CLIENT assume full financial responsibility for any loss or damage to studio gear, furniture, or facilities caused during their session or time at the studio. The STUDIO CLIENT understands that the FACILITY MANAGER reserves the right to prohibit the STUDIO CLIENT and/or their PHOTOGRAPHY CLIENTS from using the studio in the future if they fail to substantially compensate the FACILITY MANAGER for any damages caused.

Removal or equipment, furniture, props, and any other object found on the premises will be considered as theft and can result in criminal charges.

Guest count is strictly limited to the approved number. Recreational smoking and drugs, open flames, and unauthorized alcohol use are prohibited while on the premises. The facility should only be used in accordance to the terms of the agreed package booking. Access to unauthorized rooms/sets are prohibited.

If the FACILITY MANAGER provides a quote to the STUDIO CLIENT, the fee will be charged at that agreed rate. Where extra expenses or time are incurred or needed by the FACILITY MANAGER as a result of alterations to the original quote by the STUDIO CLIENT or otherwise at their request, the FACILITY MANAGER will reserve the right to charge the STUDIO CLIENT extra expenses and fees. 

THE CLIENT agrees to pay extra charges equivalent to the cost of an-hour's booking if their lateness leads to an extension of their agreed booking time. Subject to their schedule, the FACILITY MANAGER may extend the time booked studio time. STUDIO CLIENT understands that an extension is not guaranteed.

Setup and cleanup must happen within the reserved window. Staying past the end time may incur extra hourly charges.

The STUDIO CLIENT must return the studio clean and in its original condition, removing all trash and props not previously provided by the FACILITY MANAGER.

The FACILITY MANAGER asserts their right to penalize STUDIO CLIENTS and PHOTOGRAPHY CLIENTS who do not abide by the terms of this agreement. This may include but not be limited to barring STUDIO CLIENTS and photography clients from future access to the studio.

The Studio Client has read this Terms of Service in its entirety and agree to all its terms. The Studio Client understands that this Agreement is applicable to the Laws of the state of Antigua and Barbuda.
